The control you get from running your own superannuation fund brings with it great responsibilities.

Like all superannuation products that receive favourable tax treatment, you must ensure that you, as trustee(s) of your Self-Managed Super Fund abide by the rules.

As the trustee of an SMSF you must always:

  • Act honestly in all matters concerning your Fund
  • Act in the best interests of all Fund members and their beneficiaries whenever you make decisions
  • Ensure that all SMSF assets are managed separately from other non-superannuation assets the members own
  • Ensure the Fund complies with the superannuation laws and the Fund’s trust deed
  • Ensure the Fund has a clear investment strategy and that strategy is adhered to
  • Ensure you know and understand your obligations as a trustee.

Failure to perform your duties as a trustee according to the super laws can result in a loss of the tax concessions that normally apply to your SMSF and you/your SMSF may face penalties.
